What's the Law?
Wage garnishment is the court ordered withholding of earnings directly from an employee’s paycheck (typically for payment for child support, bankruptcy, or tax payments). The Consumer Credit Protection Act (CCPA) forbids employers to discriminate against employees with wage garnishment. It also limits the amount of earnings that may be withheld in a given week.
Am I at Risk?
Employers found guilty of discharging an employee because of their wage garnishment situation may have to reinstate their employment, and pay wages lost during unemployment. If the violation is determined to be willful, the employer may be fined up to $1000, imprisoned for a year, or both.
